A. Any person who knowingly transfers or dispenses more than one (1) ounce but not more than two (2) ounces of marijuana, as defined in Article XVIII, Section 16(2)(f) of the Colorado Constitution, from one person to another for no consideration commits a noncriminal municipal offense and shall not be deemed dispensing or the sale thereof.
